The CD-ROM is for official use only by Phi Delta Theta Fraternity and its affiliates, and its use for any other purpose is strictly prohibited, except as expressly allowed below.
You are authorized to install and view the CD-ROM and to use the CD-ROM for personal communications with individuals listed in the CD-ROM. You may only install and use one copy of the CD-ROM on one computer. You may not permit any third party to view or use the CD-ROM. The CD-ROM was compiled in the following manner: (a) Phi Delta Theta Fraternity provided Harris Connect with the most recent biographical information in its files; (b) Harris Connect attempted to update mailing addresses, telephone numbers, e-mail address and other contact information, as applicable, through third party vendors with which Harris Connect executed confidentiality agreements; and (c) Harris Connect made commercially reasonable efforts to verify the biographical information provided to Harris Connect with each individual by e-mail and/or telephone. In no event will Harris Connect and/or Phi Delta Theta Fraternity, their respective shareholders, members, directors, managers, officers, employees, agents or affiliates be liable for any damages whatsoever (including, but not limited to, indirect, incidental, consequential, special or exemplary damages, lost profits, or damages resulting from loss of data or business interruption) arising out of your use of the CD-ROM or the inclusion of your biographical information in the CD-ROM, even if Harris Connect and/or Phi Delta Theta Fraternity has been advised of the possibility of such damages. Harris Connect will not be liable for any loss or damage exceeding the purchase price of the CD-ROM.
The CD-ROM and the Software used to create, protect, organize and retrieve the information contained on it are proprietary information belonging to Harris Connect, LLC and its third party licensor. All biographical information, text, photographs, video and other content ("Content") contained on the CD-ROM is proprietary information belonging to Phi Delta Theta Fraternity, unless otherwise attributed. The CD, Content and Software are protected under the Federal Copyright Act, Title XVII of the United States Code and Title 37 of the Code of Federal Regulations. Harris Connect, LLC, its third party licensor, and Phi Delta Theta Fraternity retain all of their respective rights, title and interest in and to, and ownership of, the CD-ROM, Software and Content. Any reproduction, distribution or use of the CD-ROM, Content or Software, either in whole or in part, including any form of copying and/or preparation of derivative works thereof, for any reason without the express prior written consent of Harris Connect, LLC and Phi Delta Theta Fraternity, is strictly prohibited. The biographical information contained in this CD-ROM was compiled in the following manner:
a) Phi Delta Theta Fraternity provided Harris Connect (the ôPublisherö) with the most recent information contained in its files at the time the project commenced.
b) Publisher attempted to update certain contact information through third-party research vendors with which it had executed confidentiality agreements, with all such research having been done using publicly available information.
c) Publisher made every reasonable attempt to verify the biographical information with each individual directly via mail, e-mail, or telephone. Updates given by individualsÆ close relations, professional or personal assistants may have been applied.
d) Certain information submitted by individuals to this CD-ROM may have been excluded or edited at their request or at the discretion of Phi Delta Theta Fraternity or the Publisher.
e) Certain information may have been excluded at PublisherÆs discretion pertaining to individuals working in sensitive professions such as law enforcement.
